Yin Yang House Does Not Provide Medical Advice

The information contained within our site, including text, graphics, images and other material ("Content") are for informational purposes only. The Content is not intended to be a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician, or other qualified health provider with any questions you may have regarding your health. We do not recommend or endorse any specific tests, acupuncturists, bodyworkers, herbalists, energy therapists, healers, physicians, products, procedures, opinions, or other information that may be mentioned on our site. Reliance on any information provided by Yin Yang House, Yin Yang House staff, others appearing on our site at the invitation of Yin Yang House, or other visitors to our site is at your own risk.

Content and features are subject to change or termination without notice in the editorial discretion of Yin Yang House. All rights not expressly granted herein are reserved to Yin Yang House and its licensors. If you violate any of these Terms and Conditions, your permission to use the Content automatically terminates and you must immediately destroy any copies you have made of any portion of the Content.

Liability of Yin Yang House, Staff and Affiliates

The use of the Yin Yang House Site and the Content is at your own risk.

When using the Yin Yang House Site, information will be transmitted over a medium that may be beyond the control and jurisdiction of Yin Yang House and its suppliers. Accordingly, Yin Yang House assumes no liability for or relating to the delay, failure, interruption, or corruption of any data or other information transmitted in connection with use of the Yin Yang House Site.

The Yin Yang House Site and the content are provided on an "as is" basis. Yin Yang House and its suppliers, to the fullest extent permitted by law, disclaim all warranties, either express or implied, statutory or otherwise, including but not limited to the implied warranties of merchantability, non-infringement of third parties' rights, and fitness for particular purpose. Without limiting the foregoing, Yin Yang House and its suppliers make no representations or warranties about the following:

1. The accuracy, reliability, completeness, currentness, or timeliness of the Content, software, text, graphics, links, or communications provided on or through the use of the Yin Yang House Site or Yin Yang House.

2. The satisfaction of any government regulations requiring disclosure of information on prescription drug products or the approval or compliance of any software tools with regard to the Content contained on the Yin Yang House Site.

In no event shall Yin Yang House, its suppliers, or any third parties mentioned on the Yin Yang House Site be liable for any damages (including, without limitation, incidental and consequential damages, personal injury/wrongful death, lost profits, or damages resulting from lost data or business interruption) resulting from the use of or inability to use the Yin Yang House Site or the Content, whether based on warranty, contract, tort, or any other legal theory, and whether or not Yin Yang House is advised of the possibility of such damages. Remedies under these Terms and Conditions are exclusive and are limited to those expressly provided for in these Terms and Conditions.

User Submissions, Discussion Forum Usage and Practitioner Directory Listings and Websites

Yin Yang House is not responsible for any content posted within our Discussion Forum or included in any directory listing or practitioner profile within our Practitioner Directory. You agree that you will not upload or transmit any communications or content of any type to the Public Areas (including message boards, practitioner websites, ask a practitioner postings, etc.) that infringe or violate any rights of any party. By submitting communications or content to the Public Areas, you agree that such submission is non-confidential for all purposes.

Yin Yang House is not responsible for the consequences of any communications in the Public Areas. However, we reserve the right to remove or edit any posting, practitioner directory listing or website if we find they fail to conform to our terms and conditions.

By using any information within our Discussion Forum or Practitioner Directory you agree that you are solely responsible for your own communications, the consequences of posting those communications, and your reliance on any communications found in those areas. All payments for subscriptions to these areas are non-refundable.

As a practitioner you also agree to not post information about your own practice websites, your practice location, etc. within the public forums. We have paid directory memberships for this purpose and will remove this information from posts and any postings which are made for purely spamming purposes (i.e. done just to have your links and/or information posted). Our service is provided free of charge and our directory memberships are very affordable and serve to allow us to continue offering this site.

In consideration of being allowed to use the Public Areas, you agree that the following actions shall constitute a material breach of these Terms and Conditions:

1. Using a Public Area for any purpose in violation of local, state, national, or international laws;
2. Posting material that infringes on the intellectual property rights of others or on the privacy or publicity rights of others;
3. Posting material that is unlawful, obscene, defamatory, threatening, harassing, abusive, slanderous, hateful, or embarrassing to any other person or entity as determined by Yin Yang House in its sole discretion;
4. Posting advertisements or solicitations of business;
5. After receiving a warning, continuing to disrupt the normal flow of dialogue, or posting comments that are not related to the topic being discussed (unless it is clear the discussion is free-form);
6. Posting chain letters or pyramid schemes;
7. Impersonating another person;
8. Distributing viruses or other harmful computer code;
9. Harvesting or otherwise collecting information about others, including email addresses, without their identification for posting or viewing comments; consent;
10. Allowing any other person or entity to use your identification for posting or viewing comments
11. Posting the same note more than once or "spamming"; or
12. Engaging in any other conduct that restricts or inhibits any other person from using or enjoying the Public Area or the Site, or which, in the judgment of Yin Yang House, exposes Yin Yang House or any of its customers or suppliers to any liability or detriment of any type.

Yin Yang House reserves the right (but is not obligated) to do any or all of the following:

1. Record the dialogue in public chat rooms.
2. Investigate an allegation that a communication(s) do(es) not conform to the terms of this section and determine in its sole discretion to remove or request the removal of the communication(s).
3. Remove communications which are abusive, illegal, or disruptive, or that otherwise fail to conform with these Terms and Conditions.
4. Terminate a user's access to any or all Public Areas and/or the Yin Yang House Site upon any breach of these Terms and Conditions.
5. Monitor, edit, or disclose any communication in the Public Areas.
6. Edit or delete any communication(s) posted on the Yin Yang House Site, regardless of whether such communication(s) violate these standards.

Yin Yang House reserves the right to take any action it deems necessary to protect the personal safety of our guests or the public. Yin Yang House has no liability or responsibility to users of the Yin Yang House Site or any other person or entity for performance or nonperformance of the aforementioned activities.

Privacy Policy and Confidentiality

The Yin Yang House does not release any information regarding its members, customers, or visitors to anyone outside of our staff for any reason. This includes all correspondence with the Yin Yang House as well as website traffic and visitor logs. Upon logging into our site your session is kept active with the use of browser cookies which will track your activities while on our site. These logs are never shared and are destroyed every 3 days. While you may elect to be contacted via your membership profile, the use of our site to contact members for marketing purposes is strictly against our policies and abuse should be reported immediately. All email, telephone, and written correspondence of any nature sent to the Yin Yang House is kept strictly confidential.

Advertisements, Searches and Links to Practitioners and Other Sites

The Yin Yang House may elect to display advertisements for certain products of value to our readers and to display ads from brokers such as Google and Amazon. All advertisements for external sites will be marked as such: "Ads by Google", "Amazon.com", etc. We do not accept any advertisements for non health related products, services or schools, although they may appear via the brokered links.

The Yin Yang House may provide links to practitioner sites either hosted on our site or on other servers as well as to other sources of information on the internet. Yin Yang House also may select certain sites as priority responses to search terms you enter. Yin Yang House does not recommend and does not endorse the content on any third-party websites or practitioner websites hosted by us. Yin Yang House is not responsible for the content of linked third-party sites, sites framed within the Yin Yang House Site, third-party sites provided as search results, or third-party advertisements, and does not make any representations regarding their content or accuracy. Your use of third-party websites is at your own risk and subject to the terms and conditions of use for such sites. Yin Yang House does not endorse any practitioner, product, idea or treatment mechanism on the Yin Yang House Site.

With regard to the practitioner listings: practitioners have paid to be listed with our site and with this comes the ability for them to submit full-length content. The fees for membership are $40/year for practitioners and $20/year for students and all payments are non-refundable. The Yin Yang House and it's staff are not responsible for any of the content within their listing, practice information or any content that they may submit. Non premium members who are practitioners on our site are not permitted to list practice information and links to their practice within their basic profile. All information of this nature will be removed.  We also reserve the right to deny practitioner listings for any reason including, but not limited to, proximity to our locations and/or affiliates to avoid mis-representation, intentional or non-intentional, as well as mis-representation of qualifications, etc.

Products purchased via our Site or Third-Party Sites

Our site provides product links to third-party site and for sale from our own store. For third-party sites we cannot be held responsible for any purchases that you may make and matters must be handled directly with the third-party vendors. For products available from our site, you must use them at your own risk. There are no refunds of any kind for any reason, so please ask questions before you purchase. For herbal supplements we cannot provide diagnosis over the internet or phone, so if you have questions please contact your healthcare provider directly.

Idemnity

You agree to defend, indemnify, and hold Yin Yang House, its officers, directors, employees, agents, licensors, and suppliers, harmless from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your violation of these Terms and Conditions.

General

Yin Yang House is based in Somerville, Massachusetts, in the United States of America. Yin Yang House makes no claims that the Content is appropriate or may be downloaded outside of the United States. Access to the Content may not be legal by certain persons or in certain countries. If you access the Yin Yang House Site from outside the United States, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction. The following provisions survive the expiration or termination of these Terms and Conditions for any reason whatsoever: Liability, User Submissions, Indemnity, Jurisdiction, and Complete Agreement.

Jurisdiction

You expressly agree that exclusive jurisdiction for any dispute with Yin Yang House, or in any way relating to your use of the Yin Yang House Site, resides in the courts of the State of Massachusetts and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of the State of Massachusetts in connection with any such dispute including any claim involving Yin Yang House or its affiliates, subsidiaries, employees, contractors, officers, directors, telecommunication providers, and content providers.

These Terms and Conditions are governed by the internal substantive laws of the State of Massachusetts, without respect to its conflict of laws principles. If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect. No waiver of any of these Terms and Conditions shall be deemed a further or continuing waiver of such term or condition or any other term or condition.

Complete Agreement

Except as expressly provided in a particular "legal notice" on the Yin Yang House Site, these Terms and Conditions constitute the entire agreement between you and Yin Yang House with respect to the use of the Yin Yang House Site, and Content.
